These Terms of Service govern your use of the Shark Group online store and any products or services we offer through it (the "Services"). By accessing or using the Services, you agree to these Terms. Please read them carefully.

Section 1 – Access and Account

By using the Services, you confirm that you are at least the age of majority in your state or province. If you are allowing a minor dependent to use the Services on a device you own or manage, you take responsibility for that use.

To place an order or access certain features, you may need to provide information such as your email address, billing details, and shipping address. You confirm that everything you provide is accurate, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Accounts cannot be transferred, sold, or assigned to anyone else.

Section 2 – Our Products

We do our best to represent our products and services accurately. That said, colours and appearance may vary depending on your device and its settings. We do not guarantee that what you see on screen will match exactly what you receive.

Product descriptions and availability are subject to change without notice. We reserve the right to discontinue any product or limit quantities at any time, for any reason.

Section 3 – Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not confirmed until we send you an acceptance. Payment must be received and processed before an order is accepted.

Please review your order carefully before submitting. Once accepted, we may not be able to accommodate cancellation requests. If we decline, change, or cancel your order, we will notify you via the contact details provided at checkout.

Purchases are for personal or household use only, not for commercial resale or export.

Section 4 – Prices and Billing

Prices are subject to change without notice. The price charged will be the price displayed at the time your order is placed, as confirmed in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, handling, or customs charges.

Promotions and discounts run from time to time and are subject to their own terms. Where there is a conflict between a promotion's terms and these Terms, the promotion terms apply.

You agree to provide accurate and complete billing information and to keep it up to date. By submitting payment, you confirm that you are authorised to use the payment method provided and that all charges will be honoured.

Section 5 – Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, or events outside our control. Once your order has been handed to the carrier, risk of loss and title passes to you.

Section 6 – Intellectual Property

All content on the Services, including trademarks, logos, text, images, graphics, video, and audio, is owned by Shark Group, its affiliates, or its licensors and is protected by applicable intellectual property laws.

You may use the Services for your own personal, non-commercial purposes only. You may not reproduce, copy, distribute, modify, or use any content from the Services without our prior written consent. All rights not expressly granted here are reserved.

Shark Group's names, logos, and product names are our trademarks. Shopify's names and logos are Shopify's trademarks. Do not use either without prior written permission.

Section 7 – Optional Tools

We may give you access to third-party tools through the Services. These tools are provided "as is" and "as available." We do not monitor, control, endorse, or take responsibility for them. Use them at your own risk, and make sure you understand and accept the third party's own terms before using.

Section 8 – Third-Party Links

The Services may contain links to third-party websites. We are not responsible for those sites, their content, or any transactions you make there. If you leave our site to visit a third-party site, you do so at your own risk. Review their terms and privacy policies before engaging.

Section 9 – Relationship with Shopify

Our store is powered by Shopify. All purchases and sales are made directly with Shark Group, not Shopify. Shopify is not responsible for any aspect of your transactions with us, including any injury, damage, or loss related to products or services. By using the Services, you release Shopify and its affiliates from any claims arising out of your dealings with Shark Group.

Section 10 – Privacy Policy

Your personal information is handled in accordance with our Privacy Policy. Some information may also be subject to Shopify's Privacy Policy. By using the Services, you confirm you have read and understood both policies.

Section 11 – Feedback

If you send us feedback, reviews, ideas, or suggestions, you grant Shark Group a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute that content for any purpose, including operating and improving the Services.

You confirm that you own or have the rights to anything you submit, that you have disclosed any incentives received, and that your submissions comply with these Terms. We are not obligated to keep your feedback confidential, respond to it, or pay for it.

You are responsible for ensuring your feedback is accurate, lawful, and does not infringe on anyone else's rights. We may remove any feedback that we consider harmful, misleading, or in breach of these Terms.

Section 12 – Errors, Inaccuracies and Omissions

Occasionally there may be errors in pricing, product descriptions, availability, or promotions on the Services. We reserve the right to correct any errors and to cancel or change orders affected by inaccurate information, without prior notice.

Section 13 – Prohibited Uses

You may only use the Services for lawful purposes. You must not:

• Use the Services for any unlawful, harmful, or malicious purpose.
• Infringe on our intellectual property or the rights of others.
• Harass, abuse, or harm any person.
• Transmit false, misleading, or unsolicited communications (including spam).

• Upload viruses, malicious code, or anything that could compromise the Services.

We reserve the right to suspend or terminate your account at any time if we determine you have violated these Terms.

This section applies if you use or deploy any automated agent (software or service that acts autonomously or semi-autonomously on behalf of a person or entity) to access the Services.

No agent may access the Services unless it:

• Identifies itself as an agent in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string.
• Does not conceal that it is an agent (including by mimicking human behaviour or bypassing CAPTCHAs).
• Responds truthfully if asked whether it is a human or a computer.
• Does not bypass or circumvent any measure we use to control agent access.

We may limit or block agent access to the Services at any time, including by technical means. Any agent that we have requested to stop accessing the Services must do so immediately.

Section 15 – Termination

We may terminate or restrict your access to the Services at any time, without notice, at our discretion. You remain responsible for any amounts owed up to the date of termination.

Sections covering intellectual property, feedback, disclaimers, limitation of liability, indemnification, and any other provisions that by their nature should survive termination will continue to apply.

Section 16 – Disclaimer of Warranties

The Services and all products available through them are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of implied warranties, so this disclaimer may not apply to you in full.

Section 17 – Limitation of Liability

To the fullest extent permitted by law, Shark Group and its partners, directors, officers, employees, affiliates, agents, contractors, and licensors (and those of Shopify) will not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or any products purchased through them, including loss of profits, revenue, savings, or data.

Section 18 – Indemnification

You agree to indemnify and hold harmless Shark Group, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, claims, or costs (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your use of the Services.

We will notify you of any indemnifiable claim. We may control the defence of any such claim, but will not settle any claim requiring non-monetary obligations from you without your consent.

Section 19 – Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be enforced to the maximum extent possible and severed if necessary. The remainder of these Terms will continue in full effect.

Section 20 – Waiver and Entire Agreement

Our failure to enforce any provision of these Terms does not constitute a waiver of that right. These Terms, together with any policies we publish on the Services, represent the entire agreement between you and Shark Group regarding the Services and supersede any prior agreements.

Section 21 – Assignment

You may not transfer or assign your rights under these Terms without our prior written consent. We may transfer or assign our rights without notice to you.

Section 22 – Governing Law

These Terms are governed by the laws of the jurisdiction in which Shark Group is headquartered. You and Shark Group consent to the jurisdiction of the courts in that jurisdiction.

Section 23 – Changes to These Terms

We may update these Terms at any time. The current version will always be available on this page. We will notify you of any material changes in accordance with applicable law. Continuing to use the Services after changes are posted constitutes your acceptance of those changes.
